  • Creating an Account - When you register, we collect information that allows us to set up or open your account, such as your name, email address, phone number, user ID, and password. 
  • Using our Services - We receive information from you when you use our Services, such as name, address, telephone number, payroll data and benefits elections. We may also collect additional information from you when you sign-in or otherwise use our Services.

When you access or use our Services, we may automatically collect certain information about you and how you use the Services. This may include:

  • Device Information - We may collect device information such as Internet Protocol ("IP") addresses, log information, error messages, device type, and unique device identifiers. For example, we may collect IP addresses from you when you log into the Services as part of our log-in and security features.

    • send you information about Direct Care Marketplace services, and product releases.
  • Protect Direct Care Marketplace and Others - To protect Direct Care Marketplace, our clients, co-employees, and others, such as, for the purpose of combatting fraud.
  • Analyze Your Information -  We may use both manual and automated systems, such as machine learning and artificial intelligence to: 
    • analyze your information to improve our Services; 
    • personalize your experience; 
    • automate certain aspects of the Service; 
    • aggregate, de-identify or anonymize your information; 
    • provide you certain features; and 
    • protect the safety and security of Direct Care Marketplace, our Services, our clients, co-employees and others.

Data Retention

We retain your information as long as is necessary to maintain your Direct Care Marketplace account or to provide you with our Services. Once you have terminated your account, or otherwise cease using our Services, (including if we determine your account has gone inactive), we will no longer retain your information except to the extent necessary:

  • for our legal or regulatory compliance (e.g. maintaining records of transactions you have made with us), to exercise, establish or defend legal claims, and to protect against fraudulent or abusive activity on our Service; or

If we no longer need your information for the above purposes, we will generally delete or de-identify it.     • With your consent or at your direction.
    • To provide functions and services on our behalf. We may share your information with third parties who provide various functions on our behalf and enable us to provide our Services and operate our business, such as service providers.
    • We partner with another party to provide specific services. When the user signs up for these services, we will share names, or other contact information that is necessary for the third party to provide these services. These parties are not allowed to use personally identifiable information except for the purpose of providing these services. Third party information on our site is only used to enhance our site. Third party services utilized on our site are as follows:
      • Intuit - Synchronization with payroll data to Quick Books Online;
      • ONet Web Services - ONet SOC code lookup;
      • Open Weather Map - Weather lookup by location; and
      • Routing Numbers – Bank Routing Number lookup.
  • For Legal Reasons -  We may share your information with third-parties for legal reasons, including:


    • when we reasonably believe disclosure is required or permitted in order to comply with a subpoena, court order, or other applicable law, regulation or legal process;
    • to protect the rights, property, or safety of Direct Care Marketplace our Services, our clients, or others;
    • if we believe your actions are inconsistent with the spirit and language of our Terms of Service, policies or agreements;
    • to protect against or defend our Services against attacks;
    • to enforce, remedy, or apply our Terms of Service and other agreements; or

Do Not Track Signals

Under California law, operators of online services are required to disclose how they respond to "do not track" signals or other similar mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information of a consumer over time and across third party online services, to the extent the operator engages in that collection. At this time, we do not track our Users' personal information over time and across third-party online services. This law also requires operators of online services to disclose whether third parties may collect personal information about their users' online activities over time and across different online services when the users use the operator's service. We do not knowingly permit third parties to collect personal information about an individual User's online activities over time and across different online services when using the App.
